The present General Conditions of Use of the Portal, together with the general contracting conditions that govern the provision of services, and/or the particular conditions that may be established, are intended to regulate both the provision of information and the terms of supply of LiveLink Motor products through the Portal, as defined in the present Conditions of Service, as well as the commercial relations that arise between LIVELINK VENTURES S.L. and the users of this website (www.komobimoto.com).

This legal notice (hereinafter, the ‘Legal Notice’) regulates the use of our Internet portal (hereinafter, the ‘Portal’ or the ‘Website’). The use of the Website implies full and unreserved acceptance of each and every one of the provisions included in this Legal Notice. Consequently, the user of the website must carefully read this Legal Notice every time they intend to use the website, as the text could be modified at the discretion of the owner of the website, or due to a change in legislation, jurisprudence or business practice.

By using the website or placing an order through it, you agree to be bound by these Terms and Conditions and by our Data Protection Policies, so if you do not agree to all the Terms and Conditions and the Data Protection Policies, you should not use this website.

L may, at any time and without prior notice, modify these General Conditions of Use of the Portal, as well as the General Contracting Conditions, and/or the particular conditions that, where necessary, are included, by publishing said modifications on our website so that they may be known by Users, always before visiting the website or acquiring any goods offered on it.

The website designer is the LiveLink Motor team. By accessing and/or using this Portal, the status of User is acquired, accepting, from that moment on without exception, the content included in this Legal Notice as well as the Terms and Conditions that, in relation to certain services and contents of the Web, complement, modify or substitute the former.

The User knows and accepts that any data relating to LiveLink Motor of an economic-financial-strategic nature (hereinafter, the ‘CORPORATE INFORMATION’) is provided for purely informative purposes, and does not represent or guarantee that it is accurate, complete or up to date, and should not be relied upon as if it were.

The Site may include information or content provided by sources other than LiveLink Motor, including the Users of the Site. LiveLink Motor does not guarantee, nor does it assume, any liability for the certainty, integrity, or accuracy of such information and/or content, including in cases where there are defamatory, offensive, or illicit elements.

The Website provides Users with access to a multitude of information, services, programmes and data on the Internet (hereinafter, the ‘CONTENT’) belonging to LiveLink Motor.

LiveLink Motor reserves the right to deny or withdraw access to the Website and/or the services offered without prior notice, at its own request or at the request of a third party, to those Users who fail to comply with these General Conditions of Use of the Website.

Use of the Website is free of charge, without prejudice to the fact that certain services require the processing of personal information in order to access them, with notification of this in each case. Each User undertakes to:

(i) Provide truthful information and keep it updated at all times, in the event that for certain services accessible through the Website it is necessary to fill in an access form. The User shall be solely responsible for any false or inaccurate statements made and for any damage that, as a consequence of the information provided, may be caused to LiveLink Motor or to third parties.

(ii) To use the Website and the Services without contravening the provisions of these General Conditions of Use of the Portal and any other specific conditions that may regulate it, as well as current legislation, good faith, generally accepted uses and public order.

(iii) Not to use the Website or its Services for illicit purposes or for purposes that could harm LiveLink Motor or any third party, or that could, in any way, cause damage or prevent the normal functioning of the same.

A series of acts are prohibited in relation to the contents of the Website and/or the Services, such as information, texts, graphics, sound and/or image files, photographs, designs, or any other (‘Contents’) indicated below:
· Reproduction, copying, distribution, dissemination, public communication, transformation or modification, unless authorised by the legitimate owners or legally permitted.

Any violation of the rights of LiveLink Motor or of their legitimate owners.
Use for any type of commercial or advertising purposes, other than those strictly permitted.
Any attempt to obtain the Contents by any means other than those made available or those commonly used on the Internet, and in that case, provided that this does not cause any harm to LiveLink Motor.

The Provider responsible for the execution of the eCall service will be either Livelink or a third party. In the event that the eCall service is provided by a third party, the latter will identify itself at the beginning of the telephone connection.

Due to the nature of this service and for security reasons, calls made through the eCall Service will be recorded.

The necessary data provided by the User may be transmitted to the providers to whom LiveLink Motor has entrusted the provision of the Services, and the corresponding provider will use it exclusively for the provision of the Service in question and will keep it until the operations have been duly processed.

In addition, and for the purpose of warning other drivers about the traffic situation, certain completely anonymous information relating to the state of the road will be used and, therefore, forwarded to the corresponding service provider. No other transfer of data to third parties will take place, except when expressly consented to by the user when using the KOMOBI ‘Emergency Contacts’ service.

The eCall Service is only available in Spain. Only the Spanish language will be used for the provision of this Service.

All the content shown on the website www.komobimoto.com in particular (without this list being exhaustive): designs, texts, graphics, logos, icons, buttons, software, trade names, trademarks, industrial drawings or any other signs susceptible of industrial and commercial use are protected by Intellectual and Industrial Property regulations (R.D. L 1/1996 of 12 April, which approves the Revised Text of the Intellectual Property Law, and by the Trademark Law 17/2001, of 7 December) and are subject to the intellectual and industrial property rights of LiveLink Motor and/or third parties who are the owners of the same, and who have duly authorised their inclusion in the Portal.

Under no circumstances shall it be understood that any licence is granted or that there is a waiver, transmission, total or partial transfer of said rights, nor is any right conferred or expectation of right, and especially of alteration, decompilation, exploitation, reproduction, distribution or public communication, over the Contents subject to intellectual or industrial property.

No link to this website may be established from any other website without the prior and express consent of LiveLink Motor.
The User has a non-exclusive licence to use the Portal, limited to accessing the Content for the purpose of using the services provided on the Portal. The licence is granted to the User for personal use of the Portal and the Content, and may not be used for any kind of commercial or business purpose. Links or hyperlinks: The existence of links on the LiveLink Motor website, unless expressly stated otherwise, is for informational purposes only and in no case implies a suggestion, invitation or recommendation regarding them, and therefore LiveLink Motor does not accept any type of responsibility for any damage or loss derived from their use. Does not comply with the General Conditions of Use of the Portal specified herein;
Infringes or violates the intellectual and industrial property rights or other analogous rights of LiveLink Motor or any other legitimate third party owner; or Infringes any applicable regulations.

The User shall be obliged to immediately modify or remove from his/her web page any property of LiveLink Motor, or remove any link to the Page, when so required by LiveLink Motor.

Accessing, viewing and, where applicable, downloading the Content and/or Services shall always and in all cases be carried out for strictly personal and non-commercial purposes.

Notification of improper activities: LiveLink Motor maintains a policy of strict respect for the industrial and intellectual property rights of third parties. Therefore, it is strictly forbidden to send or include content on the Portal that may infringe these rights. Notwithstanding the above, and despite the efforts of LiveLink Motor, it is possible that in isolated cases a User may insert content of this kind. c. Indications and facts that point to the illicit nature of said activity, including the principle of accreditation of the claimant’s rights;

Express declaration that the information provided in the notification is accurate and of the illicit nature of the use of the contents or the carrying out of the activities described.

In compliance with the provisions of art. 10 of the LSSI, we inform Users that LiveLink Motor is the Information Society Services provider of the links that our website establishes to our profiles on social networks: (Instagram, LinkedIn, Facebook, TikTok and YouTube), and the information provided in the legal notice of this website is applicable to these profiles.

KOMOBI is not responsible for the accuracy or validity of the data and information provided through the Service.
LiveLink Motor is not responsible for the consequences derived from interruptions, cuts and limitations of the Services’ operation.
Livelink does not guarantee the safety and integrity of the driver, passengers, animals, objects and/or the vehicle when using both the device and the Service, and cannot be held liable for any reason, including damages of any kind, consequential damages and/or loss of profit.

Likewise, Livelink is not responsible for any expenses that may arise from the assistance provided by 112.

LiveLink Motor makes every effort to keep its website up to date and so that the User can access it at all times. However, it is possible that, for technical reasons, the viewing and functioning of the page or the device may not be correct or complete.
LiveLink Motor cannot guarantee that its website will be available at all times, and therefore LiveLink Motor shall not be liable for damages of any kind that may arise from, including but not limited to (i) the lack of availability of the website, inferences, interruptions, outages, or temporary suspensions of the website, (ii) computer viruses, breakdowns and/or disconnections in the operation of the electronic system or in computer devices and equipment, caused by reasons beyond the control of LiveLink Motor, which prevent or delay the provision of services or browsing; (iii) Delays or blockages in use caused by deficiencies or overloads of the Internet or in other electronic systems that may be caused by third parties through illegitimate interference beyond the control of the establishment and that are not attributable to LiveLink Motor; (iv) Any discrepancies that may exist between the electronic version and the printed version of the information, documentation and/or other content on the website; (v) The impossibility of providing the Service or allowing access for reasons not attributable to LiveLink Motor, including cases of force majeure.

LiveLink Motor may, without prior notice, temporarily suspend the content of the website for reasons of maintenance or repair of its systems and make any changes it deems appropriate to the website.
Although LiveLink Motor acts in good faith, it shall not be held responsible, directly or indirectly, for any claims that may arise from the quality, reliability, accuracy or correctness of said Content.

LiveLink Motor reserves the right to remove any comments or content published by the User on the Website that, in its opinion, are not suitable for publication, or to demand their immediate removal by the User, as well as to deny or withdraw access to this Website and/or the Content offered, at the request of LiveLink Motor or a third party, to those users who fail to comply with these General Conditions of Use of the Website.

Likewise, LiveLink Motor reserves the right to request the immediate removal of any link, comment or content related to this Portal that has been used, disseminated, distributed, published, exported, exploited, reproduced or copied in violation of the stipulations of these General Conditions of Use of the Portal by any means and in any medium.

LiveLink Motor will pursue any breach of these General Conditions of Use of the Portal, as well as any improper use of the Portal, taking all actions, including criminal actions, to which it may be legally entitled.

LiveLink Motor may withdraw or suspend the provision of services at any time and without prior notice to users who fail to comply with these terms of use or with the specific terms and conditions of a particular service.

LiveLink Motor reserves the right to remove any comments and content published by the User on the Website that, in its judgment, are not suitable for publication, or to require their immediate removal from the Users who publish them. It may also deny or withdraw access to this Website and/or the Content offered, on its own initiative or at the request of a third party, from Users who breach these General Terms of Use of the Website.

Likewise, LiveLink Motor reserves the right to request the immediate removal of any link, comment, or content related to this Portal that has been used, disseminated, distributed, published, exported, exploited, reproduced, or copied in violation of these General Terms of Use of the Portal, by any means and in any format.

LiveLink Motor will pursue any breach of these General Terms of Use of the Portal, as well as any improper use of the Portal, by exercising all legal actions available to it, including criminal actions where applicable.

If any content of these General Conditions of Use of the Portal is declared totally or partially null or ineffective, said declaration will only affect the content or part thereof that is null and void, with all other General Conditions remaining in force and said content or the part thereof that is affected being deemed not to have been included, unless, as a result of being essential to these General Conditions for Use of the Portal, they were to affect them in their entirety.

These General Conditions of Use of the Portal, as well as any relationship between the User and LiveLink Motor, shall be governed by Spanish law.

Any dispute that may arise from or relate to the use of this website shall be subject to the jurisdiction of the courts of the consumer’s domicile in accordance with the provisions of art. 90.2 of RDL 1/2007, of 16 November, which approves the Consolidated Text of the General Law for the Defence of Consumers and Users and other complementary laws.
