Prior information
LiveLink Motor informs that the procedures for purchasing goods and/or obtaining the services offered are those described in these general conditions, as well as any other specific ones that are indicated on the screen during navigation and the purchase process, in such a way that the User declares to know and accept said procedures as necessary to access the products and services offered on this website.
By using this Website and placing orders through it, the User agrees to:
1. Use this Website solely and exclusively to place legally valid orders.
2. Not to place any false or fraudulent orders. If it could reasonably be considered that an order of this nature has been placed, we will be authorised to cancel it and inform the competent authorities.
3.Provide us with your e-mail address, postal address and/or other contact details truthfully and accurately for the management of orders, and keep such details up to date. If all the necessary information is not provided, we will not be able to process your order.
4.By placing an order through this website, you declare that you are over 18 years of age and have the legal capacity to enter into contracts.
These Terms and Conditions of Purchase apply to:
1. The purchase and installation of a KOMOBI telematics device that connects to a motorcycle and/or moped (hereinafter, ‘KOMOBI Device’ or ‘Device’);
2. For the purchase and use of the KOMOBI smart identification keyring (hereinafter ‘Smart Key’) which is sold together with or separately from the KOMOBI device.
3. Any other device accessory that is available for purchase on the website.
Together, all the Devices will be referred to as the ‘KOMOBI Package’.
For your use of the KOMOBI telematic mobile phone application (hereinafter, ‘App’) which is made available to you through the purchase of a Device, please refer to the App’s Terms and Conditions of Use.
The KOMOBI Package is supplied by LiveLink Motor.
Below are the legally binding Terms and Conditions of Purchase for the use of the KOMOBI Package as a product/service that must be agreed to before purchasing a branded device.
Assumptions
These Purchase Terms and Conditions constitute the entire agreement between LiveLink Motor and the User who purchases the KOMOBI Package (hereinafter the “Buyer” or “Customer”) and/or uses the KOMOBI Package (hereinafter the “User”) with respect to the goods and services related to the KOMOBI Package.
The functionalities of the App may only be used through the interaction of the App itself with the Device. You may consult the App’s Terms and Conditions of Use here.
The Buyer agrees to comply with the Purchase Procedure set out in this document.
It is the Buyer’s responsibility to ensure that their contact details are always kept up to date during the Purchase Procedure. LiveLink Motor shall not be liable or accept any responsibility in the event that the KOMOBI Package fails due to inaccurate contact information provided by the Buyer.
LiveLink Motor may unilaterally amend these Purchase Terms and Conditions. In this regard, LiveLink Motor will notify the User and/or Buyer of any changes to the Purchase Terms and Conditions at least one month prior to their entry into force.
Any User who transfers ownership of the vehicle with the installed device may send an email to KOMOBI Customer Service, attaching the purchase invoice for the device and a copy of their ID. Once KOMOBI receives this documentation, it will reset the installed device, restoring it to its factory settings.
The functionalities of the KOMOBI service are provided for use throughout the European Union (as well as the United Kingdom and Norway), except Switzerland.
Purpose and application
Please read these Terms and Conditions of Purchase before purchasing, installing and/or using the KOMOBI Package.
These Terms and Conditions of Purchase include important information regarding your rights, compensation and exceptions to our liability to you, thus defining the rights and obligations within the framework of this Website and in the commercial transactions between LiveLink and its users.
By purchasing and/or installing KOMOBI, the customer accepts these Terms and Conditions of Purchase which are legally binding. Thus, any order placed and confirmed through the Website implies full adherence to these Terms and Conditions of Purchase by the User and/or Buyer, without exception or reservation. If you do not accept the Terms and Conditions of Purchase, we will not supply you with the Device or grant you the licence for the App.
All data provided by the User and/or Purchaser and the registered order confirmation shall be valid means of proof of the transaction.
These Terms and Conditions of Purchase refer specifically to the User and/or Purchaser who makes use of the KOMOBI Package and to the vehicle in which KOMOBI is installed. Unless LiveLink Motor agrees otherwise, the Terms and Conditions of Purchase will be binding solely and exclusively between LiveLink Motor and the Buyer , and therefore LiveLink Motor will not be obliged to any third party, unless said third party has expressly accepted these Terms and Conditions of Purchase in a written document of adhesion, with the prior knowledge of LiveLink Motor.
Please bear in mind that if you have only downloaded the App and do not have the device installed on the motorbike or moped, you will not be able to enjoy all the KOMOBI functionalities.
eCall service
The Provider responsible for the execution of the eCall service will be either Livelink or a third party. In the event that the eCall service is provided by a third party, the latter will identify itself at the beginning of the telephone connection.
Due to the nature of this service and for security reasons, calls made through the eCall Service will be recorded.
Once the device has been correctly installed, if it detects that the vehicle has suffered a collision or accident, the Provider responsible for the execution of the eCall Service will automatically contact the main User of the Service through the telephone number provided in the application registration process, to verify their status and manage contact with the 112 emergency service, or with any other emergency service, whether it be the State Security Forces (Civil Guard, Regional Police, Local Police, National Police), Fire Brigade, Red Cross, Civil Defence, or any other similar service, if the situation requires it. If, after a few minutes, the call made by the Provider to the telephone number provided by the User has not been cancelled or, if it is not possible to establish such contact with the User, the Provider responsible for the execution of the Service will analyse the impact and the situation of the vehicle, to the best of its ability and, if it deems it necessary, the aforementioned Provider will arrange for assistance from any of the aforementioned emergency services.
In those cases in which it is necessary to organise assistance for the User from any emergency service, all the information necessary to deal with the emergency will be passed on to that emergency service, that is, the vehicle details, the User’s details, a description of the impact and the condition of the vehicle, as well as other necessary information of a similar nature.
Likewise, in the event that another person is driving the vehicle, in order to manage the assistance service, the User must provide the Provider responsible for the execution of the assistance service with the telephone number and name of the driver, and the Provider will act in accordance with the provisions of the previous paragraph.
The use of the eCall Service requires the identification and localisation of the vehicle, as well as the transmission to the emergency call control centre of the information necessary to provide timely assistance.
The necessary data provided by the User may be transmitted to the providers that LiveLink Motor has commissioned to provide the Services, and the corresponding provider will use it exclusively for the provision of the Service in question and will keep it until the operations have been duly processed.
In addition, and for the purpose of warning other drivers about the traffic situation, certain completely anonymous information relating to the state of the road will be used and, therefore, forwarded to the corresponding service provider. No other transfer of data to third parties will take place, except when expressly consented to by the user when using the KOMOBI ‘Emergency Contacts’ service.
If the KOMOBI device is in ‘alarm’ mode, that is, due to theft of the vehicle, misuse of the device or other similar reasons, the eCall Service will be automatically deactivated and cannot be used in the event of an accident or collision.
The eCall Service is only available in Spain. Only the Spanish language will be used to provide this Service.
The scope of the functionalities of the eCall Service are limited to the characteristics offered, excluding, in any case, any issue related to the safety and integrity of the driver, passengers, animals, objects and the vehicle itself.
KOMOBI recognises accident situations through the information captured by the device’s sensors and, based on previously defined parameters. LIVELINK MOTOR, in its eagerness to improve, uses its best efforts to expand the different scenarios and circumstances that can occur in an accident, although this does not prevent the system from not recognising the emergency situation in anomalous situations and, consequently, the emergency call is not activated.
Availability of the eCall service
The eCall Service is provided through a SIM card installed in the KOMOBI device linked to the User’s mobile phone. The proper functioning of the eCall Service depends on the KOMOBI device.
Therefore, the Service may at times be (a) limited by the reception and transmission capacity in each area of the radio transmitters operated by the relevant network operators; (b) particularly affected by atmospheric and/or topographical conditions, the position of the vehicle, or the presence of obstacles (bridges, buildings, etc.). In addition, the correct provision of the Service requires that a mobile telephone network for the SIM card is operational.
The Service may experience interruptions due to force majeure events, including strikes, lockouts, and official orders, as well as for technical reasons, including, for example, maintenance, repairs, software updates related to systems, or expansions required for the operation or improvement of KOMOBI systems or those of its traffic information providers or network operators. Service interruptions may also occur due to temporary network overload caused by peaks in service activity or failures in third-party telecommunications systems. KOMOBI will make all reasonable efforts to remedy incidents as quickly as possible or to adopt the necessary measures to resolve issues.
Likewise, the alert reception center of the eCall Service Provider may experience interruptions due to force majeure events, including strikes, lockouts, and official orders, as well as for technical reasons, including, for example, maintenance, repairs, software updates related to systems, or expansions required for the operation or improvement of the alert reception center’s systems or those of its traffic information providers or network operators. Service interruptions may also occur due to temporary network overload caused by peaks in service activity or failures in third-party telecommunications systems.
KOMOBI will make all reasonable efforts to remedy incidents as quickly as possible or to adopt the necessary measures to resolve issues.
The proper functioning of the eCall Service depends on:
Correct installation and calibration of the device
Availability of coverage
Atmospheric and/or topographical conditions
The position of the vehicle or the presence of obstacles (bridges, buildings, etc.)
The device being actively recording a route at the time of the accident
For the correct operation of this Service, the device must have updated firmware (Version 20 or higher). Such updates occur automatically when the vehicle is not in motion and the installed device is within a coverage area. The User is responsible for any update that is not completed or is executed incorrectly.
The Customer may report any incident affecting the Service through KOMOBI’s customer support service.
KOMOBI reserves the right to modify the scope of the services provided, provided that such modifications do not substantially and globally alter the agreed scope of the services. In the event of significant modifications that substantially alter the scope of the services offered, the Customer may terminate the contract for this Service within 15 days of receiving written notice or an email from KOMOBI, after which KOMOBI’s customer support service will deactivate the Service free of charge.
Purchase procedure
The items to be purchased must be selected and added to the shopping cart by clicking on the corresponding icon.
The shopping cart will display the name of the selected item(s) (taxes included), the quantity of selected items, options, shipping costs, and the total order amount.
To complete the purchase, the buyer’s personal details will be required. These details will be incorporated into our database in order to process the order and, where applicable, facilitate future purchases through the Website. The personal data provided by customers will be processed in accordance with our Privacy Policy.
The Customer may access the personal data provided and the information related to orders placed at any time. LiveLink reminds customers that personal data must be provided accurately in order to avoid confusion or issues with the delivery of the purchased item(s). In addition, if the Customer has expressly consented, they will receive personalized commercial communications by email and/or SMS tailored to their profile.
Before placing the order, the Customer will be shown a summary identifying the product(s) added to the shopping cart, the total price (including shipping and taxes) with each itemized cost, and the shipping details, so that the Customer may confirm the order by clicking the button labeled “Place Order”.
At the moment the Customer clicks the “Place Order” button, they fully and unreservedly accept the entire content of these Website Terms and Conditions, which include the Purchase Terms and Conditions. The User may print a copy of these terms or request that they be sent to the email address provided.
If, before confirming payment, you detect an error in your order, you may modify any detail by clicking the “edit” or “delete” button.
If an error is detected in your order after completing the payment process, please contact our Customer Service at [email protected] or by phone at +34 673 803 973.
Once the order has been placed, the order number will be communicated through the Website so that the Customer may track the order at any time and from their device. Likewise, an automatic email will be sent to the address provided by the Customer acknowledging receipt of the order, including a description of the order and the personal data provided. Failure to receive this message may be due to a temporary network communication issue or an error in the email address provided. In both cases, LiveLink recommends that the Customer contact Customer Service.
Receipt of the aforementioned order acknowledgment does not constitute acceptance of the order by LiveLink. The Customer’s order constitutes an offer to LiveLink to purchase the product(s). All orders are subject to acceptance by LiveLink, and LiveLink is not obligated to accept any order and may, at its discretion, refuse acceptance. The Customer acknowledges, however, that by clicking the “Place Order” button, they assume the obligation to pay for the product(s) when LiveLink accepts the order. When LiveLink accepts the order, it will notify the Customer by sending a further email confirming that the order has been shipped or, where applicable, that it is available for collection (the “Confirmation”).
All orders are subject to product availability. If, at the time of order processing, LiveLink detects that any of the products included are out of stock, LiveLink will attempt to source the product by other means available to it. If this is not possible, the Customer will be notified immediately. In addition, the amount charged for the unavailable and undelivered item will be refunded to the Customer in the following days, using the same payment method used for the purchase.
Right to non-acceptance / Cancellation of an order
LiveLink may cancel any confirmed order or refuse an order for the following reasons:
· In the event of a technical error and/or typographical error in the prices or in the rest of the product data contained on the Website when the order was placed;
· Due to lack of availability as described in the previous point;
· When the security systems indicate that the order may be fraudulent;
· When there are reasons to indicate that the Customer is a minor;
· When LiveLink has not been able to deliver the order to the address provided by the Customer;
· When there is a computer attack, virus or any event that is beyond LiveLink’s reasonable control (force majeure).
In such cases, LiveLink will fully reimburse the amounts that would have been paid in accordance with the provisions of the section ‘withdrawal and return’.
Price
Prior to final confirmation, you will be able to check all the data entered, which may be corrected by the User. Final confirmation of the order implies the conclusion of the contract with LiveLink Motor.
The prices of our products are indicated in euros with all taxes included (VAT and other taxes applicable on the date of the order). They do not include duties, customs fees, processing and shipping costs.
For all LiveLink Motor shipments made outside the European Union, transport costs are exempt from VAT. Customs duties are the responsibility of the User and are not included in the shipping costs.
LiveLink Motor reserves the right to modify its prices at any time, but the product will be invoiced according to the rate in force at the time the order is validated and subject to availability.
Payment
By validating your order, you are obliged to pay the indicated price.
On the screen corresponding to the payment of the order, the different means of payment available will appear, indicated with the corresponding logos (as well as the cards accepted), which are as follows:
a) Credit or debit card: The bank details collected through the payment gateway are encrypted and transmitted securely to the bank’s servers. Credit or debit cards will be subject to verification and authorisation by the issuing entity, but if said entity does not authorise the payment, we will not be held responsible for any delay or non-delivery and we cannot formalise any contract with the User. LiveLink Motor reserves the right to take whatever legal action it deems appropriate against anyone who carries out a fraudulent transaction or enters credit or debit card details without the authorisation of the cardholder. In the case of payment by credit or debit card, the order will not be considered effective until the LiveLink Motor Administration Department obtains bank confirmation of payment. The Website uses information security techniques generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorised access to data. To achieve these ends, the User/Buyer accepts that the provider obtains data for the purpose of the corresponding authentication of access controls.
b) LiveLink Motor agrees to process payment through the Paypal system.
c) LiveLink Motor agrees to process payment through the Stripe payment platform.
d) LiveLink Motor accepts the option to defer payments with the integrated SeQura platform.
e) LiveLink Motor agrees to process payment through the Amazon Pay system.
f) LiveLink Motor accepts to process the payment through the Bizum system.
Regardless of the chosen payment method, the Buyer will receive an order confirmation email. The order details will be registered by LiveLink Motor in the personal account created in the Portal by the User.
The payment for the orders is collected as soon as the order is validated.
Subscription and renewal of subscriptions
The connectivity rates charged are those set out here.
The User is responsible for the correct renewal of their account. To do so, they must go to the website www.komobimoto.com, at least two days before their subscription expires, to the renew-connectivity section and re-contract the service according to the chosen rate.
The User shall indicate the accepted, valid and current payment method, which can be updated whenever deemed appropriate.
After the first renewal, connectivity will be automatically renewed upon expiry for annual periods, unless the user deactivates the automatic renewal. In that case, upon expiry, the user will no longer have access to the device’s functionalities.
If you do not wish to renew your subscription, your account will be cancelled and you will be removed from the system.
Once your account has been cancelled, all its content will be deleted after thirty (30) days.
KOMOBI reserves the right to cancel an account or prevent the use of the Software by those who do not comply with these conditions of use, without granting any right of compensation to the User.
Conditions of shipment and delivery of the order
Once the payment has been verified and validated, LiveLink Motor will proceed to prepare and deliver the order. The necessary billing and delivery details will be provided by LiveLink Motor, in accordance with the Privacy Policy.
The User is responsible for correctly indicating the shipping address for the order and for coordinating with the courier/transport company for delivery of the device. In the event of an incorrect address being provided, LiveLink Motor, or the courier/transport company responsible for delivery, will try to contact the User and resolve the error but declines all responsibility derived from these errors on the part of the User.
Products purchased through the Website/App will be sent via a courier/transport company and will be delivered within a period of time indicated on the Website/App at the time of placing the order, according to the selected delivery method.
In the event that the deadline stipulated at the time of placing the order expires, the User may cancel their order in accordance with the conditions established in these Terms and Conditions of Purchase. However, if the delay in the delivery of the order is caused by force majeure, the User will be informed of this circumstance while the product is in the logistics phase and that, in this case, the costs arising from a possible request for cancellation will be borne by the User. Each delivery is considered to have been made from the moment the transport company makes the product available to the Customer, which is materialised through the control system used by the transport company.
The cost of transport is calculated according to the chosen delivery method and the total price of the products purchased.
The exact cost of transport will be calculated when each item is added to the shopping cart and will be itemised on the page summarising the purchase before the order is confirmed by the Customer by clicking on the ‘Checkout’ button and before the payment details are entered.
It will not be possible to send orders to military bases or PO boxes. Shipping costs may be modified at any time without prior notice. Such change will be applicable from the moment the modification is included in these Terms and Conditions of Purchase. In any case, the shipping costs that appear at the time the order is placed will be valid.
Orders in advance
In the event that the purchased product is not in stock, KOMOBI will offer the Buyer the option of purchasing it in advance, as a reserve. These orders will have the following characteristics:
· The purchase procedure is as described in the section ‘Purchase procedure’.
· The price will be paid at the time the order is placed.
· When placing the order, and using the method indicated in the order confirmation, the estimated delivery date will be indicated.
If the delivery date changes, you will be notified by email.
Modifying a pre-order: If you notice an error in your order after completing the payment process, please contact our Customer Service Department at [email protected] or by phone at +34 673 803 973. )
Cancelling a pre-order: The Buyer can cancel the order while it is listed as ‘pending’, ‘confirmed’ or ‘in progress’. In this case, it will be processed as a refund.
Once the order is listed as shipped, it cannot be cancelled, and the ‘Withdrawal and Return’ procedure described in this document must be followed.
Complaints
As soon as you take possession of the products ordered, the risk of loss or damage to the products is transferred to you.
It is the User’s sole responsibility to check the condition of the order upon arrival, to express any observations and to make any complaints that he or she deems necessary.
If the order arrives damaged, the User must send a photo of both the shipping box and the product it contains as soon as possible, and always within the first working day after receiving it. Along with the photo, the order number must be sent to the email [email protected] and LiveLink Motor will contact the User as soon as possible to resolve the issue.
If, 10 working days after the email confirming that the order has left the LiveLink warehouses has been sent, the User has not heard anything about their order, the Customer should contact LiveLink Motor via email at [email protected], indicating that they have not yet received their order.
The User can make a complaint or claim to the Customer Service Department by email (sent to [email protected]) or by writing to the Customer Service Department, LiveLink Ventures S.L. C/Brasil, 24 (Sevilla), C.P. 41013, telephone number +34 673 803 973.
Furthermore, LiveLink Motor has Complaint Forms available to its customers at the establishment in question. We recommend that users process their complaint at the establishment responsible for the effective provision of the service.
Withdrawal and return
To exercise the right of withdrawal, you must notify LIVELINK VENTURES S.L. of your decision to withdraw from the contract within the first fourteen (14) days from the material possession of any of the devices in the KOMOBI Pack, by sending a registered letter to the registered office of LiveLink Motor at calle Brasil, 24, 41013, Seville, or by email with acknowledgement of receipt to [email protected] . You may use the model withdrawal form below, although its use is not mandatory.
In order to meet the withdrawal deadline, it is an essential legal requirement that the communication relating to the exercise of this right by you be sent and received by LiveLink before the legally established deadline expires.
The withdrawal period indicated in the two preceding paragraphs shall not apply to the purchase of ‘Services and functionalities’ of digital content listed in the Shop section of the Website, under the terms of Article 103.m) of the General Law for the Defence of Consumers and Users. By accepting these Terms and Conditions of Purchase, you declare that you are aware of and expressly consent to the execution of the contracted digital content service from the moment of contracting it, as well as the loss of your right of withdrawal in the acquisition of said digital content services.
Consequences of withdrawal
In general, in the event of withdrawal by the Customer, we will refund all payments received by LiveLink, including shipping costs up to the limit of the cheapest option offered by LIVELINK VENTURES, S.L. when the order was placed and, in any case, after deducting the costs of collecting the Device.
The Customer has the option of organising the return of the device at their own risk and expense, in which case they will be refunded the full amount paid, including shipping costs up to the limit of the cheapest option offered by LIVELINK VENTURES, S.L. when the order was placed. In this case, the Customer shall be obliged to return the order to the registered office of LIVELINK VENTURES, S.L. located in Seville, at 24 Brasil Street, postcode 41013, within a maximum period of fourteen (14) calendar days, counting from the date of receipt of the Device. The return period will be considered fulfilled if you return the order before the end of the period.
The device must be returned in its original packaging and with all its original contents in perfect condition, without having suffered any damage. In the event that LIVELINK VENTURES, S.L. detects any damage to the returned device, it will inform the Customer as soon as possible and will inform them of the valuation of the damage.
Once LiveLink has received the order and checked its condition, we will proceed to refund the amount paid using the same payment method used for the initial transaction within a maximum period of fourteen (14) days.
KOMOBI parcel guarantee. Liability and limits
In accordance with the provisions of Article 120 of the General Law for the Defence of Consumers and Users, the KOMOBI Package has a three-year repair or replacement warranty from the delivery of the device, regardless of whether or not the buyer installs the KOMOBI package (hereinafter, the ‘Warranty Period’). In the case of digital services or content, this warranty shall be valid for two years from the purchase of the service.
In accordance with the provisions of articles 117 et seq. of the General Law for the Defence of Consumers and Users, if the KOMOBI Package is incomplete, stops working or develops faults caused by defective components, workmanship or design (hereinafter ‘Non-compliant Device’) and provided that it is within the Warranty Period, LiveLink Motor will repair and/or replace the equipment free of charge, unless the repair involves disproportionate costs for LiveLink Motor, in which case it will be replaced, with LiveLink Motor bearing the shipping costs.
If the digital content or services do not comply with the contract, the User shall have the right to demand that they be brought into conformity.
Unless otherwise provided by law, LiveLink Motor shall not accept any liability for the following losses, damage or lack of conformity, regardless of their origin:
(i) if the device has been tampered with, modified or repaired by persons other than representatives approved by LiveLink Motor;
(ii) if the device or installation cables have been changed or tampered with, except with the express consent of LIVELINK VENTURES, S.L.;
(iii) if the device has been subject to misuse, accident or normal wear and tear;
(iv) if the device has been connected to lines not indicated by the manufacturer;
(v) if the device has been installed incorrectly;
(vi) breakdown of the battery of the vehicle in which the device is installed;
(vii) any loss that is not attributable to any breach on your part;
(viii) business losses (including loss of profit, income, contracts, anticipated savings, data, loss of goodwill or unnecessary expenses incurred).
The operation of GPS and/or GNSS networks is beyond the reasonable control of LiveLink Motor.
In general, Livelink Motor will not be held responsible for any breach or delay in the fulfilment of any of the obligations assumed, when this is due to events that are beyond our reasonable control, that is, due to force majeure.
When purchasing the KOMOBI package, the User can pay for the connectivity: (i) on an annual basis (premium package); (ii) or pay an amount equivalent to five years (plus package).
Procedure for repair or replacement of the ‘Non-compliant Device’
LiveLink Motor will proceed to collect the non-compliant Device within seven (7) calendar days of receiving the notification of non-compliance from the Customer. In this notification, the Customer must indicate the collection address and a telephone number so that the transport company can contact the Customer, if necessary. If, after two collection attempts by the transport company, it is impossible to collect the Device, the Customer will be obliged to organise the return of the order and bear the cost of the return.
Once LiveLink Motor has received the non-compliant Device, it will proceed to repair or replace it as quickly as possible.
In case of Theft
Please note that KOMOBI is a product designed to send a notification to your mobile phone if your vehicle is moved without the keys and without the ignition being turned on, when the system is ‘activated’.
If you realise or suspect that your vehicle has been stolen, you should take the following steps immediately:
(i) Immediately report the theft to the relevant police or state security force and inform them that the vehicle is equipped with a tracking device so that they can use the KOMOBI system as part of their recovery efforts and/or criminal investigation. The User should not attempt to recover a stolen vehicle.
(ii) Regardless of how the User becomes aware of the stolen vehicle, it is still the User’s responsibility to inform the police and take action to recover the vehicle.
The recovery of a stolen vehicle with the KOMOBI Device installed is not part of the service provided. LiveLink Motor will not accept any responsibility for recovering a stolen or lost vehicle or asset. LiveLink Motor will not reimburse the User if their vehicle is not recovered or if it is damaged.
LiveLink Motor is also not responsible if their Device has been installed incorrectly, resulting in system malfunction and/or vehicle theft.
If the User and/or Purchaser uses the KOMOBI Package for any purpose other than to locate the stolen vehicle in accordance with these terms, LiveLink Motor may be entitled to claim damages (where applicable) and will be entitled to terminate these terms.
Applicable law and jurisdiction
These terms are governed by the relevant laws of Spain and are subject to the jurisdiction of the relevant courts of Spain.
In accordance with Article 29 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, electronic contracts between entrepreneurs or professionals, in the absence of an agreement between the parties, shall be presumed to have been concluded in the place where the service provider is established.
Any dispute that may arise from or relate to the use of this website will be subject to the jurisdiction of the courts of the consumer’s domicile in accordance with the provisions of art. 90.2 of RDL 1/2007, of 16 November, which approves the Consolidated Text of the General Law for the Defence of Consumers and Users and other complementary laws.
